Clarification regarding dismissal of reconciliation proceeding

Can a reconciliation proceeding under Industrial Disputes Act be dismissed due to non appearance of Claimant?

Yes, it can be dismissed on account of non appearance of the employee/ labour. Generally, in reconciliation proceeding, on request by counsel, adjournment can be granted.

A reconciliation proceeding is to settle down the prevailing dispute in between the parties. It is bound to suffer if both the parties who are supposed to take part in the proceedings refused to cooperate each other or the court.
So if one party is not appearing before the conciliation officer then it is bound to get dismissed from that place. But then in such situation it will come before main court where you will have right to contest and win the case.
