Central Civil Service Disciplinary Proceeding/Pension delayed

15-Oct-2023 (In Labour & Service Law)
Sir, I have retired from Central Govt Defence Civilian service on 29 Feb 2016 on superannuation attaining the age of 60 years. I was Group D Industrial Employee. Pension Payment Order was already served to the payee Bank and me. After that on 13th Jan 2016, just before one and half months of my retirement and after rendering more than 37 years of regular and qualifying service and after issuance of Pension Payment Order, a 'Show Cause Notice' was issued to me on the pretext that a complaint through CPGRAMS was received that I got appointment/enroled in duplicate 'SC' certificate. Then "Charge Sheet' was issued on 02 Feb 2016. I had filed a petition before Hon'ble CAT Calcxutta. There after a letter for withholding of pensionery benifits was issued. Hon'ble CAT gave order to make payment of provisional pension and the petition was disposed of without asking any reply from the respondents. I did not get/I have not got monthly pension/ other pensionery dues till date.

MY OPINION THAT you have so many options that you can move the Hon'ble CAT Tribunal and /or you can before Hon'ble High court at competent jurisdiction for not effect of the court order till date, i think ,it is better to decide where you actually move after observation of the total brief accordingly, contact with me just now.
