Arrears and Full and Final Payment after Resignation

25-Apr-2023 (In Labour & Service Law)
I am an Ex- employee of a private limited company having office at Nagpur. I resigned from the company on 28th Feb,2019. Till date the company had not paid my full and final amount. As per Companies Policy the full and final settlement will be made after 45 days from the date of resignation. As per the internal sources of the Company they are not going to pay my variable pay intensive (fixed amount which was a part of my CTC) for the FY 2017-18. The company had issued the increment letter dated 25-02-2019 to all the existing employees on 2nd March, 2019 i.e. after 2 days of my last working day in the company. The arrears for the FY 2017-18 were disbursed to existing employees in March,2019. But the same were not released to ex- employees. What are the legal options available.Please guide.

This is my response to you:
1. You can send a legal notice;
2. You can then approach labour court as last option;
3. or a civil court by filing suit for recovery;
4. Consult a local lawyer and take steps.
