Signed On Separation Of Marriage Bound Without Willing By Force

Me and my husband registered our marriage. Now a mother of his son too. But his family did not accept is so he had changed got engaged with another girl seen by his family. While I was pregnant my husband and his family took signature from and my parents as witnessess on the ₹200 stamp paper for the separation of marriage. And now they are ready get married to the engaged girl. But I want live with husband. My husband also did not care for me while I was in hospital for delivery. Now I'm at my parents home due to I needed care. Please guide me what proper action I should take to stop the marriage and I'm not interested in divorce as I want to live with my husband. Pls guide me.

Madam,

Without any delay please file a case for restitution of conjugal rights and also file a maintenance case against your husband. The Bond paper that signed by you not stand legally. As you told you have registration certificate of marriage. Only by the court has the power to cancel the registration certificate. Until other wise the arraignment will be considered as till in existence.

Please proceed by filing a restitution of conjugal rights. If he married to other women then it will be difficult to proceed legally. Right now it is the best time to move with the necessary application to the court. If it was done once, the other person who ready for marriage will stop. There is chance.
