What are the sections on which a married man if promises to marry non married woman with a divorce pending can be encountered

A married man if marries any woman be it married, unmarried or a divorcee, he can be tried under bigamy as such marriage will be null and void, but if he divorces his erstwhile wife he can remarry after the stipulated time as per the statute is concerned
