26-Sep-2023 (In Family Law)
Hindu arrange marriage. Husband army person.Shaadi k 3yrs ho gye. har tarike se dekhne k baad bhi yahi result hai Ki mere husband kitna bhi sudhar jaye but vo kabhi bhi daughter ko city me achhe school me nhi padhange or na hi mujhe kabhi job karne denge. N both are too much important for me. he is too much miser n selfish. Unhe sirf apni body apna Paisa or apne saman se hi Matlab hai nothing else not even baby. So i don't want to live with him. In-laws are Orthodox n live in typical village. So I just want matainance without divorce but he want either both or nothing. Today he send a family court summon now what to do. Currently m living at Lucknow with my parents n my baby. I wrote letter to Awwa but didn't get any proper response.

You need to write to his boss in army and claim maintenance. This way they will earmark a small portion of his salary and send it to you directly every month as you maintenance. As regards to the summon that you have received from the Family Court, there is a good probability that your husband must have file a case here in Lucknow/ Consult a local lawyer.

Dear Client, As per your query it is not clear under which section the summon were issued against you in Family Court. It is clear from your query that you are currently residing at Lucknow, so is your case in which summons are issued, is filed at Lucknow or at some other Family Court. In any case since the summon is issued against you, you will need to be appearing before the Court concerned. If you need any other advise into the matter, do feel free to contact. Regards, Tushar Bahadur, (Advocate), High Court Lucknow.

Dear client! If you are Living at your parental home then you can claim for maintenance of your child and for you . You may also file a case under domestic violence act to provide shelter\place of residence, as far as the summon of family court is concerned you should file a reply through your Advocate. And appear before the hon'ble court.

Hello Divorce by mutual consent is the best way out if he is ready to part ways and give you sufficient money. If not then file a case for maintenance and divorce. The court shall grant you enough money to support yourself and the baby. He must have sent a s 9 application so that you come back home. Regards

On the above mentioned query please clear me the disertion period. And on the above mentioned it is very clear that you are entitled for filling a case for maintenance against your husband. And don't forget to add your daughter in the plaintiff.
