Q: Consumer Rights problem that need to be addressed.
I have a situation where a consumer buys a product that is a tool for weed killing, in the instructions manual it is specified that only the "Standard Unleaded petrol" should be used for the tool. When he went into garden he noticed some weeds and decided to use the weeding tool to get rid of them. He noticed that the tool had run out of fuel. Instead of going to the station, he decided to use "Super Unleaded petrol" because he had beer just moments before and decided not to drive. As a result of this a huge flame erupted and burned down his shed causing 50000 in damage and the tool is damaged beyond repairs. How would we advise such a guy on his statutory rights and remedies?
Advocate Rahul Mishra answered
if the instructions were to use standard fuel but you used super unleaded fuel then you didn't follow the instructions as stated along with the equipment.now the company may take this plea when you go to the court.
