Ma'am,

You can definitely definitely get a divorce. If your husband also wants a divorce then it can be with mutual consent and will be simple procedure. Else we can contest the same.
In addtion you can also get maintainance for your child as well as yourself (depending on your income).

Please feel free to contact to take the case further.

Yes ma'am
You can file for divorce in the court.
You can also seek divorce by way of mutual consent if your husband is also willing to get seperated or by contesting in the family courts where one can also seek pre litigation mediation.

Hello Ma'am, you can both apply for a mutual divorce. if you are in Delhi, I would suggest that you that go for a pre-litigation settlement agreement in Mediation centre. Then you can file your divorce without any hindrance as all the settlement terms will be recorded.

If your husband is interested in getting a divorce and you too are on board with it. Both of you can apply for a mutual divorce after discussing the terms of separation, maintenance and child custody.
However, if any one of you does not want a divorce, the other one may file for a contested divorce but with apt reasons. Also then the judge as per your profession and child will decide the terms for maintenance, child custody etc.
