I'm a 30yrs Hindu girl. I got married in 2008, after 10 years of marriage, my husband confessed to me that he doesn't want to continue our relationship. We have 7 year old son. Can I get Divorce?

Both of you can apply for a mutual divorce after discussing the terms of separation, maintenance and child custody.However, if any one of you does not want a divorce, the other one may file for a contested divorce but with apt reasons. Also then the judge as per your profession and child will decide the terms for maintenance, child custody etc.



Q: Divorce on the ground of denial of conjugal rights and cruelty

I am 42 years old Hindu seeking a divorce from my wife of 12 years has a daughter aged 7 years. My wife has been living at my inlaws house since 2011 at pretext of child care, her career. Off late since 2015, we are not even on talking terms. I have one question: Am I eligible to seek divorce on the basis of restitution of conjugal rights and cruelty and how tough it will be to get divorced if my wife does not agree for mutual consent divorce?
