How to punish husband for bigamy

My sisters husband has done second marriage without the divorce ..... My sister is with my father right now .... She was abused by his husband, her father in law , her mother in law because not to come back,,,, now her husband had done second marriage .... What should we do?

Dear Conceren,

Your sister has right to file the case for divorce against her husbnad under grounds of adultry. Further your sister also can claim maintainance from her husband. Further your sister also can file Domestic violene case against her in laws for harrasing.

File complaint against him in police station for bigamy with any proof if any, on your report police can inquire your complaint by calling him in police station or can direct take Cognizance against him, if police has failed to do so, you have remedy to file private complaint before JMFC with you facts and in addition to that you file application in divorce petition which is pending before family court, best of luck

As per Hindu Personal laws a second marriage without ending the first marriage would be null and void.

If a Hindu Man or Woman wishes to remarry while their existing spouse is alive the only way to go about doing the same is to get a valid divorce.
If one does so, she can be booked under IPC 494 which may result imprisonment up to 07 years with fine and second marriage will become null & void.
