As i am Hindu, under which section i can get residence order?nI was residing with my husband and in laws after marriage for 6 months which is owned by in laws only. nAs per in laws and husband words, i left matrimonial house. After 6 months of seperation i told husband to take me back but he denied. nI filed dv case (sections 12,18,19,20,21,22) and 498a in march 2022. Till date i haven't got any maintenance order. I don't want to break my marriage.How could i get residence order? And what if husband and in laws still denied to take me inside after getting residence order?

The court held that the daughter-in-law can exercise her right to live in the shared household, which is completely owned by the in-laws until her husband finds alternate accommodation. Right of Share Household for any woman in a domestic relationship is guaranteed under Sub-Section (1) of Section 17 and she cannot be evicted, excluded or thrown out from such a household even in the absence of there being any form of domestic violence.
