Family issue in which my brother in law hit me several times.

Today, in afternoon my brother in law beat me and my husband who is physically disabled, the reason was that, my husband stopped him to put his things, outside my home, when daughter also came in between to protect me, when he was beating me and my husband. Then we file a case against him, and not he has filed a case against me and my family in which his mother, who is my mother in law is stating that, me and my daughter tried to attack her. And police is intimidating my daughter that her future will get destryed as she is a student and her name is mentioned in a police case.

As per the details you've provided your brother in law has committed offences of Criminal Trespass Section 441 IPC, Section 452 House trespass with preparation to cause hurt and Causing Hurt under Section 323 IPC. He has also committed offences under Section 354 IPC assault with intent to outrage the modesty of a woman and if he used abusive language then Section 509 IPC will also be attracted.

2. It seems that no FIR has been registered in either case. Getting receiving in written complaint to SHO is not enough. One should insist on FIR number or ask police to give zero FIR.

3. If you feel the police is unable to help you, then you may approach the court under 156(3) CrPC to issue directions to the police to register FIR and start investigation.

4. It is necessary to get the medical examination done as soon as possible to collect evidence of injuries and hurt caused.

5. Being a complainant and a victim of a crime does not ruin anyone's future prospects or career. Getting ones name mentioned in a criminal case does not disqualify a person from appearing for government job exams.

I have perused the contents of your FIR and would advise you to insist for FIR since as per the details provided your brother in law has committed Criminal Trespass which is punishable Section 441 IPC, Section 452 House trespass and Simple Hurt U/s 323 IPC. Just follow it up and insist for FIR number and in case they won't you may contact us. We will help you file application under section 156 (3) seeking directions to police to register an FIR.

It’s a case of cross fir. I would suggest you and your family to straight away apply for the anticipatory bail and keep yourself safe as the other party may include some grave offences against you n your daughter.
