in this regard, i advice you to immediately approach concerned LD. MM and file a DV petition before the said court thereby seeking residence order and other related orders wherein your inlaws will be restrained from committing and inflicting any sort of cruelty and violence on you and your child, further you can have interim custody of the children your favour otherwise your husband will take away the kids with him. If he is not telling about his income and other things, court will inquire about his details thereby directing him to bring on record his income affdavit in the court and if he fails to bring the same on record, then court depending upon your lifestyle and status can very well grant you and your children maintenance. for further clarification, please contact.

Query perused. I would advise you to file a petition for maintenance under section 125 crpc. You can also file a complaint under section 12 of the domestic violence act and seek maintenance, separate residence. For further consultancy and legal services you may contact us.

definately u can ask for monthly maintaince for u as well as for ur kids. but, the amount vary from ur salary to ur husband monthly salary...wherein, he has to file his income affidavit and the properties which he owns. if he doesnt have immovable property in his name, den u wont get the property rights. However, u can seek for accodomation alngwith alimony amount and monthly maintaince for kids education and other misc. exp enses
