Requirement for Registration- Common maintenance Service agreements

09-Jun-2023 (In Documentation Law)
Please guide whether for the Common Maintenance Services Agreements - having an Yearly Value/Consideration of Rs. 96,00,000/ approx,, is it required to get the Agreement Registered by paying the applicable stamp duty ?The agreement is to be executed at Delhi Location. Here for Common Maintenance Services we meant the 01. Maintenance of Common Areas, of Lifts, of Fire Safety Equipment, overall cleanliness of the common areas etc etc. These services are being provided by the Apartment Owners' Association to the Tenants in the building- which is rented out for the commercial purposes. Hence, keeping in view of the nature of services being offered and annual value, whether it is mandatory for the parties to the agreement to get the same duly Registered by paying the applicable STAMP Duty or not?

It would be great if the agreement is register to safeguard future consequences.
Absolute stamp duty is not mandatory.
Can make it get registered under the general clause and that will protect your interest absolutely.
