Would like to apply divorce from husband

I would like to apply for a divorce. Am separated from my husband for nearly 2 yrs & currently staying with my parents. I have a female kid, she is 9 yrs old now. I am from Christian community. I am not interested to talk with my husband & request for mutual consent for divorce. Would like to know the possible way to get the divorce with no harm to any one. I have female kid, i want to take care of her. what is the timeline to get this process completed & suggest the best way out for me have peaceful life. This request is for my class mate, a female.

You can as simply apply for a divorce in a family court. In Tamilnadu, on an average, such cases take two to three years. Once granted, you can design your life so to live with peace and lead life for your child.
If you file divorce by mutual consent then it will end in a short period. on contested divorce the time limit cannot be predicted. If your husband is not willing for it you can file separate divorce petition. At any stage you can convert the divorce in to mutual consent.
first ask your class mate to post a proper query. the divorce under christian community can be processed under Indian divorce act. the sec 10 deals with that. it is advised to avoid to post the query for your friends or relatives or others because the person who posts query did not know the exact fact of the case.
