Child Custody: As the primary caregiver, you can file a custody petition under the Guardians and Wards Act, 1890. Courts consider the child's best interests, including emotional bonding, upbringing environment, and the child's preferences. Highlight that the child is more comfortable staying with grandparents rather than daycare. Emphasize your stable living conditions and ability to provide emotional and educational support. Visitation Rights: If custody is disputed, you can request interim visitation rights under the same act. Courts generally allow the non-custodial parent reasonable access, which could include weekends, holidays, or daily interactions, depending on the circumstances. Stopping Unilateral Decisions: A wife cannot unilaterally take decisions about the child without consulting you, as both parents have equal legal responsibility. File a petition under Section 9 of the Hindu Marriage Act, 1955 or seek an injunction in family court to direct her to return to the matrimonial home and maintain the child's current school. Emphasize the stability of the child’s education and the family environment.

Yes, it is possible to stop the wife from unilaterally taking all the decisions with respect to the child. In fact, both the parents should act in the interest and welfare of the child. The law also says so. As far as visitation rights are concerned, you can get the same by making an application in Court for the same. Feel free to contact me for seeking any legal advice/assistance as regards the same.

Well, you can file a case to seek Child Custody in the concerned Family Court located nearby to the place where you were last residing together as a couple after marriage. At least , you will get Child Visitation rights being a Father.

Well, in order to get the Child Custody as a Primary Caregiver, you need to file a case before the concerned Family Court Judge seeking either Custody of the Child or Visitation Rights to meet the child!
