Where can I file divorce local or native place

Hi, I live in Gurugram temporary for job (more then 1 year), permanent live in Roorkee. Now, in adulatory by wife case (she is doing in Gurugram), 1. may i file divorce in Roorkee? 2. i may have death threats from wife side so is there a way just after filing divorce and notifying to wife, she can be separated from me and my childrens immediately?

Sir As per the facts stated by you, in case you file in roorkee, your wife may get it transferred from Supreme court to different state that is Haryana Gurgoan Sir please elaborate more on the issue as to separation because immediately separation cant take place Please feel free to contact me for better understanding on this issue. you can file divorce petition where you and your wife lastly resided or where your wife is currently residing or where your marriage was solemnized. So you have options to file this case as per above-mentioned jurisdiction. If you receive any kind of threat from your wife. You can move application before concerned police station.

You can file a case in Roorkee but you can also file in Gurugram as well. By formal fir regarding this will help you out. Took your children and start living separately and file a case……………………………………………………………………………..

As per Section 19 of Hindu Marriage Act. The case can be filed where a) where the Marriage was solemnized, or b) The respondent at the time of the presentation of the petition resides, or c)The parties to the marriage last resided together, So if your marriage solemnized in Roorkee then you file for divorce there. Otherwise you need to file in Gurgaon.
