Q: Property transfer issue ..............................

Owner of house died intestate now to transfer house all legal heir have to give affidavit indemnity and noc attested by executive magistrate (sdm office)one of the legal heir due to old age can't go to court for all this how can be transfer possible in this case ?

Since one of the legal heirs is very old and unable to attend the SDM office, the property can still be transferred by executing a Special Power of Attorney in favour of another legal heir, supported by a medical certificate. The attorney holder can sign and complete all affidavits, NOC and indemnity formalities. Alternatively, attestation can also be done through home visit by the Executive Magistrate.”

Q: Need Legal Help for Forced Marriage and Divorce

I’m a 29-year-old male, forced into marriage 1.5 years ago by my family through emotional and physical threats. I had clearly said no.There is no bonding, and I had informed the girl it was a forced marriage, but she still agreed. Now she wants to continue; I don’t.My family pressures and threatens me to stay, and I feel mentally disturbed and trapped.I want to file for divorce, but I’m the only one willing. If you are not willing to continue this marriage then you can file divorce case. No one can stop you to file divorce. If she agrees then you can file mutual consent divorce under section 13b Hindu marriage act. But now the situation is different you can file under section 13 of Hindu marriage act on the ground of cruelty etc. This is the only way to get separate but it will take time. We have to prove the grounds.

Q: Name change in adhaar card for the third timeird time

Want to change name in the adhaar card for the third time in adhaar card as on my mmbs and 10 degrees my surname is different as in my adhaar card can I change as my limitation exceeded due to error by operator

Yes you can file suit for declaration before the civil court. Thereafter on merit the court will order to change your name in your aadhar card. It will take maximum one to two years for decision of case.

Q: Where can I file divorce local or native place

Hi, I live in Gurugram temporary for job (more then 1 year), permanent live in Roorkee.Now, in adulatory by wife case (she is doing in Gurugram), 1. may i file divorce in Roorkee?2. i may have death threats from wife side so is there a way just after filing divorce and notifying to wife, she can be separated from me and my childrens immediately?

you can file divorce petition where you and your wife lastly resided or where your wife is currently residing or where your marriage was solemnized. So you have options to file this case as per above-mentioned jurisdiction. If you receive any kind of threat from your wife. You can move application before concerned police station.

Q: My husband cheating and I want to punish him

My husband has affairs and sleeps with other women.So is there any way to punish him and get back my rights as a wife.

You can file maintenance and domestic violence case against him and as well as divorce case on ground of adultery. But there is no law to punish him through criminal proceedings. He is liable to maintain you rest of your life.
