What is the procedure for alimony in case of divorce

We have been married for 14 years with 2 kids , a boy (13 yes) and a girl(7 yrs). Since beginning, my understanding with my in laws was not good. But now, after my father in laws death, my mother in law is a pain. My husband doesn't like my behaviour with his mother and want divorce. Sometimes he hit me also. If we do mutual consent divorce, still I will be getting alimony and taking my daughter with me.

That depends on your understanding with your husband in terms of divorce. If both of you agree to divorce then we can discuss about the the alimony and custody of child. Through mutual consent it can be possible more can be discussed after meeting

Divorce by mutual consent by parties should be filled by parties only after prior settlement of terms and conditions with regard to Permanent alimony and maintenance for wife or husband as the case may be, custody and guardianship issues of the children, return of Istridhan of wife, settlement of all joint bank accounts and settlement of joint property issues amicably. The best course is to enter in to a written agreement or Memorandum of Understanding that both parties witness and sign. This agreement or MOU becomes part and parcel of the joint petition for divorce in the Family Court. All settlements agreed by both parties have to be completed before the final order of divorce is given by the Family court which on being satisfied of these settlement pass such order dissolving the marriage by decree of divorce.

Mutual consent divorce, as the name suggests, is a divorce with mutual consent based on terms and conditions decided mutually by the parties to the petition. you can ask your husband for alimony and custody of your daughter for being ready for mutual consent divorce. in case, he refuses, you also can refuse to grant the divorce.
