Hello if the marriage is not working you can file a divorce with mutual consent on settled terms and conditions like stridhan, maintenance etc. If mutual consent does not workable file petition for maintenance u/s 125 Crpc and petition for contested divorce

A suit for judicial separation along with a suit for maintenance can be filed in the family courts to provide you with adequate reliefs. Whereby you could also file a suit under domestic violence act and ask for an alternative residence for you to stay in. Furthermore, as stipulated above, the fact that you being a home maker might also mean that your own source of income was through your husband, which strengthens your case regarding maintenance. If you have kids and wish to retain their custody, they shall also be maintained by your husband.

it looks like that you both are seeking separation, as you both want to be separated, in that situation you both need to file petition under section 13b mutual divorce of Hindu Marriage Act. just ask any lawyer to file the partition on your behalf in a district court where you reside or your partner resides.
