you can approach the family court under Section 13 and file for contested divorce . nobody can deny you the right of having is successful divorce from your husband if the relevant Grounds exist . it is my opinion that you must approach the learned family court without any further delay to ensure that the divorce proceedings are initiated and culminated in time for your future plans.

You told that you have been married for 1 year and you have been with your husband only for 20 days and during this period your husband's behavior towards you is very bad and you think your husband is psychoYou don't want to live with your husband but your husband doesn't want to divorce you and he has filed a section 9 case and you want a quick divorce and marry someone elseBut if your husband is not ready to give you divorce then you can also file an ex parte divorce case on the ground of cruelty to your husband.

Since your husband is not ready for divorce, you may file contested divorce. In response to his section 9 petition for restitution of conjugal rights, you may also give your version of cruelty committed by the husband.
