Police has the power to forward the complaint to caw cell. However, you have filed a complaint too, therefore you can redeem legal remedies from court and can also suspend her rights before caw on merit. Please feel free to reach out directly for further assistance.

Yes sir the Police has the power to forward the case to the CAW Cell, as that is a special cell made for crime against women specially. Once the case is forwarded to the CAW Cell you will have to appear before the Cell and defend yourself there. I hope this advice helps you.

Implications of maintenance order under section 125 CrPC are very severe. Often leads to journey in jail for its non obeyance and non payment. With non payment, there is also accumulation of arrears, which can not be done away without their payment. Spending time in jai for non payment of maintenance would not nullify the payment and its order. so better pay the amount or go for appeal against the order. Thanks

You can file a suit for recovery against your brother-in-law for recovery a sum of ₹85,000/- and you can also claim damages for the same. But in order to file the suit you need to send the legal notice prior to it. I would advice you to take quick action for the same as there are certain time limitations under the law in order to file the suit for recovery. For further assistance please feel free to contact. Thank you.
