Settlement of matrimonial cases mutually

12-Jun-2024 (In Divorce Law)
There is an E mail from husband's lawyer for mutual settlement of cases against him. I also want to go for it if compensation is adequate. My query -- If I reply this email in positive. can my husband use my email in the court to stop/pause proceedings in the court as my interim maintenance case is in order stage. My lawyer says that my husband is trying to delay the process and he can show my email to the judge. Thanks.

It is always encouraged to settle matrimonial disputes cordially. However it is often used by some parties to delay the Court proceedings without being serious about the settlement. It is also extremely important to specify your important terms and conditions clearly to avoid disappointment later. Any communication between parties can be used as evidence in Court. Family Court provides facility for mediation and conciliation if both parties are interested which can be utilized in your case. Discuss with your advocate and he will be happy to do the needful to settle your matter to your satisfaction. Good Luck.

As you said, you have filed some cases against your husband in the court, one of which is probably the maintenance case which you have mentioned, Your husband's lawyer has emailed you even before the settlement in the court that he is ready to settle with you, to which your lawyer's response is that this is just a matter of fact and he will use the same email in the court also. Could do it to show

any communication done by you with your husband can be a substantial peace of evident and same can be considered by the honorable Court and since the order is likely to be there on the maintenance issue so I will advise you not to communicate our correspondence with your husband in anyway.

Your mother should file eviction civil case against your wife immediately as well seek her eviction from her house under the Maintenance and Welfare of Parents and Senior Citizens Act 2007, simultaneously. Your wife can always file injunction order against you and your mother from evicted from the shared household under the Protection of the Women from the Domestic Violence Act 2005. Now who files these cases against other and get eviction order or injunction order all depends the capability of your lawyer. Mind you, if your wife get injunction order against you all from evicting her from shared household which is your mother's house, then you won't be able to throw her out till you get divorce from her. Also without waiting file for divorce against her on the ground of cruelty in the Family Court.
