Q: Challegened Chargesheet filed in dowry case in high court
Cahrgesheet was filed against me in dowry case. i had appealed against quashing of chatge sheet in high court. High court has again provided mediation. I want to know what will happen if mediation fails. Will the hogh court allows the quashing by seeing the evidences or not? Also i want to know do i need to goto mediation?

Why?If wife has sufficient income and means to maintain herself no court will allow her maintenance in DV case under the PWDV Act 2005.As far permanent alimony and maintenance in divorce case is considered, there too the Family Court shall take in consideration the financial condition of both parties before deciding application for this relief.The elaborate affidavits of income and assets of both parties are to be filed along with salary slips, bank statements and income tax returns for 3 years for the courts in all cases relating to maintenance claim and alimony that will clarify the financial situation of both parties.One thing more, nothing comes free of cost so stop seeking free legal advice like this.

I am 30 yr old, recently relieved from Asst manager post in a Public Sector Bank, mother of a 2 year old. Yes you can seek your share in the Hindu Mitakshara family if you are coparcener and by birth you have share in this coparcenary property.The Hindu Mitakshara undivided family property should be undivided for at least four generations upto you and then you get share in this property but if that property was your grandfather's or grandmother's self acquired property which was inherited by your father and it became his self acquired property then you cannot ask your share in that property.The origin of this property has to be proved by you to get share in the property and show this property was part of Hindu Mitakshara family and it was undivided property for generations.
