Remedy in case wife not allowing visitation rights to the father

Hi Sir Im aged about 42 married a married women in the year of 2007, At the time of marriage she having a male child aged about 6 years.As per her words she has applied for divorce as his husband having relation with another women and she got decree of divorce. We have girl child in the year of 2010 and we lead a happy life till 2016.Im a corporate employ and resigned my job in 2015 and started a business a in March 2015,Business got failure and i gone into financial crises and raised some disputes.She didn't understand my situation and applied for divorce in April 2016. From then she is not accepting see my daughter and she has taken all the household with help of local police in the month of July 2016. She filed divorce under U/s13-1-ia. Please help me how to see my daughter and im not interested to give divorce as i loved her lot. Pls help wt to do now.

You can file a petition before the Family Court seeking permission to visit your daughter and then the court after hearing you grant the orders to visit and see your daughter.....

Hi,
You can avail an visiting rights towards your daughter and without your concern court can't decree the divorce ,you need to prove your love and effection towards your wife and daughter.

Dear Sir,

You can file child custody petition before the family court of the jurisdiction where presently your daughter is living with her mother and fight for the custody of your daughter. Since the welfare of the child is of paramount importance, the court will see who is the best guardian for the child to be granted her custody. The court will look into every aspect of welfare of the child viz., education , food, shelter and all other basic needs and if you strongly fight for the custody, you might be given the custody or else you might need to be content with the visitation rights of the child which will anyway be granted to you.
