14-Mar-2023 (In Divorce Law)
Hi, Please help with following: 1) What are the chances of success in Bangalore(Karnataka HC) to get a false 498a FIR quashed, after police has submitted their report that the FIR was bogus(B Report) in lower court? 2) What is the average time duration of quashing process? 3) What is the average fees to quash for a competent advocate in Bangalore(a range would also be helpful)?

(1)To quash proceedings under Section 498a, you need to file a petition under Section 482 in the High Court. Many facts and documents need to be submitted to support the case, and the police report helps but it does not have a final say. The magistrate's orders are also given due consideration.
(2) It can a few months to a year or more too. It's not possible to give an average timeline in view of the covid SOP.
(3) each lawyer's fees are different and it can only be given once the scope of work is assessed which can be after discussion with client and consideration of documents.
