04-Jun-2024 (In Divorce Law)
Once i file for divorce, if my estranged wife applies to transfer the case to her place, how and where do i oppose this? I have health condition that doesn't allow long travel. Still a middle place is ok. Is it done only in the high court?

1. the transfer petition is to be filled before the high court. 2. in the High court you can oppose transfer the petition by your advocate. 3. you can raise a strong objection explaining your health issues and pray the court does not transfer.

Hi if you have filed a divorce case in a particular particular place and your wife has apply for transfer case to her place then it may be entertained by honourable court based on the tradition. If your wife lives in the same state and then she have find for transfer of same case from one district to another district in the same mistake then it will be transferred to High Court of that state and if the wife is staying out of the state the case will be transferred by the Supreme Court.

Will she ask for transfer within the state ? then it is the high court which decides it if her place is out of the state then she has to get a transfer by order of Supreme Court. In such case you show your health condition records to court..

Dear Sir, Be informed that if the transfer is from one district to another district in the same State then such transfer petition will be filed in the concerned High Court. If the case is to transferred to the another State then your wife has to file transfer petition before the Supreme Court. In either case you will get a notice and have an opportunity to put your defence on health grounds.
