Questions Answered by Advocate Savitha Savi

Q: Partition of Self Acquired Property

Hi, I brought a plot in 2011 (1852 sqft). I constructed two portions, one on ground and other on first floor, with assistance from my sister. Now we would like to partition the property where in the ground floor (of 820 sqft) to my sister and first floor (of 960 sqft) to myself and the land ownership as undivided 50% each. How could this be done?

Advocate Savitha Savi answered
You can give the half right to your sister only through the gift deed or settlement deed because document stands in your name only. If your registered jointly then only you divide the property through partition deed. If you need further query please contact me.

I have purchased property few months ago and now the seller has gone overseas and he is willing to do rectification but he is not sure when he will be returning to India. Hence I am in a question wheather can he give power attorney to myself to make this rectification or some third person.to execute this rectification.Problem is with the survey number he has mentioned 109(P) as survey number while buying property and know I have mentioned 109 only as per (Khara,RTC ).
