14-Dec-2023 (In Divorce Law)
Hi
Me and my husband are living together with my mother at her house. We are married from past 6 years and now i want to file for divorce from him. What is the procedure for it and how should i move forward. We have a 2 year old daughter.
My husband is working with a private organisation and i was also working before having the kid. Also, in how much time i can expect it to be finalized.
Hi first of all how much time was the marriage and all where was the marriage been done and all what was the husband saying and also and all u can file a for divorce and all under the Hindu marriage act and all and tell the court that u will also be asking for maintenance and all what did the husband say and all what was the reason and all
In this regard, I advice you that you can certainly file for divorce on many grounds but you have to cite the conduct of your husband by which you are aggrieved. If suppose it’s cruelty then you can very well maintain a petition for dissolution of marriage on the ground of cruelty and furthermore, thereby citing that you mr in-laws inflicted domestic violence you can approach concerned magistrate for some protection orders of interim custody and maintenance under PwDV Act. There is basic strategy we should follow in all these cases, as we have to claim maintenance also from your husband. For getting good maintenance, you need to strategise as his income and status has to be looked into by the court while granting maintenance. For further clarification, please contact.
the proceedings for divorce re not too complicated and the length of the case will depend upon whether your husband agrees for it peacefully or whether he wants to contest it. you can take action accordigly
Hi Mam,
You may file divorce petition before the Hon'ble Court but the facts of your case would determine the ground under which divorce for petition shall be sought. You may also file maintenance petition.
