Need advice on how to avoid falling prey with 498a

12-May-2023 (In Divorce Law)
I have been married on 15th Dec 2018 and for more than a month my wife lived with my parents and for the rest 1.5 months she lived with me. It's been 2 months now she had gone to her parents and is not willing to return accusing my family and me of cruelty. though it was never a case. She always starts fighting over little dispute. I and my elder brother went to her home to bring her but at their place situation got worst over arguments with her and her brother. Her father is threatening us to file a dowry case and her girl is also not willing to return. Kindly give me some legal advice on how to avoid falling prey to false dowry allegation.

Hello sir. I have perused your legal query. You can always file a complaint for criminal intimidation against the parents and brother of your wife. As far as your wife is concerned you can file an application for restitution of your conjugal rights. Please feel free to reach out to me in case you wish to discuss the matter in more detail.

there is no actual safeguard against such a case but there is a way out, should the situation arise. you have various rights, both civil and criminal, which you can exercise and also to protect yourself from false cases.

Dear client,
she is blaming you and family ,reasons are sometimes not clear or not expressed.
But this tendency of her behaving id not good for future, bcz generally legal issues arises hereafter.
you persuaded her and tried to resolve the issue ,but all went in vain.
No, she may take legal action against you and your family.
Hence ,better firstly issue a legal notice for restitution and come back to restore conjugal relationship, along with other legal points for making safe and clear intention from your side.
You may contact for such legal draft and legal advice.
Thanks
