If you both are ready for the divorce then it is advisable to proceed through mutual consent divorce procedure. However if one party is not ready then other can proceed in contested manner. For any further legal assistance please feel free to contact Thanks

Sir, there are several grounds on which a person can give divorce to their partner, impotency is one amongst that. If you and your wife, both are interested to give divorce to each other, then in that case I would suggest you to try to file a mutual divorce by coming to terms with each other amicably. If that is not possible, then you always have an option of contested divorce open for you. For any further legal assistance please feel free to contact.

Hi The best way forward would be to either file for an annulment of marriage or a divorce by mutual consent. It will save you alot of time and hastle. Feel free to get in touch to discuss further. Regards Adv. Abhinav Sharma

Yes…impotency is an active ground for divorce. She can always file a divorce petition against you in the court. But the contested divorce has no time limit as compared to mutual divorce which gets over within maximum six months. You can also file for divorce on the basis of cruelty. For more legal assistance I am just a call away.

There are different grounds prescribed in the Hindu Marriage Act on the basis of which husband as well as wife may seek divorce from each other. If you also do have a valid ground as prescribed in law then you can file divorce petition and contest for it. On the other hand, if your wife also agree to end amicably then both of you can simply file mutual divorce which is the simplest & fastest way of getting separation.

Since both of you want divorce go for mutual consent or annulment if applicable She can file a case on that ground — as if one impotence the marriage may not work and thus separation is better peacefully

Hi Sir, Both parties, meaning you and your wife can get a annulment of marriage on the ground of impotency. It amounts to declaration of the marriage as null and void and has to be filed within 01 year of marriage. However, it is not a ground for divorce. You may however file an application for divorce on any other ground, in case more than 1 year has lapsed since your marriage. Please connect if you wish to know more in this regard

Your wife can give divorce according to the nine grounds as per the Hindu marriage act 1955 & additional 04 grounds for wife ….if you think you have some medical concerns regarding the same then it depends on you…. if you think that you can medically prove that you are physically fit and there is no such problem and you do not wish to give divorce ….then your wife has to fight the case and m and she might choose the ground of cruelty, or as applicable.. plz b in touch
