My question is on DV case against husband and in laws..

*Does dv case requires police complaints against whom we are filing the case..?*..Coz;maximum allegations are of same nature as that of allegations made in 498a application.. *Does Dv case against husband and family weakens his RCR case?*

Domestic Violence case can provide you rights of maintenance, shared house, compensation, shared house or alternate house accommodation.
Therefore you need to file police complaint for filling Domestic violence case in court.

police complaint is not the pre requisite of the dv application
allegations can be in the nature of 498a but dv act has different procedures and reliefs

to answer your last question, i must say it will not affect you RCR case

as far as physical violence is concerned the allegation I DV case can be same as 498A. but, in addition in DV case there can be other charges as well like mental, emotional abuse and economical abuse. and yes RCR case will be weakened. for further details you can contact me.

he can't file any counter case as a counter blast for the cases filed by you against him even if you loose the cases filed against him for lack of evidence he can't take any legal action against you. there are many supreme court rulings in which the appex couet time and again stated that in family matters of the complainant could not prove her case due to lack of evidence she cannot be prosecuted for filing cases against he husband
