28-Mar-2023 (In Divorce Law)
We got married in Nov 2020. After couple of months he was not happy in marriage life and I am busy with my job and got the job. He is not satisfying me sexually from beginning, he had ED issues. He behaves like a pyscho. After six moths I decided to be separated with him and I am leaving with my parents from last 1.8 years. I have received the notice section 13 1 ia from the court member filed by my husband. Shall I respond to notice that ED issue and ask him to go for impotent test in the court? please help me how to respond

Your husband has already sent you legal notice for divorce ! And even you need divorce too ! It’s better if you guys go for mutual divorce n talk for settlement amount. As you are also working n earning good therefore court has to see whether you are eligible for alimony or not ! You also have options for 498a and domestic violence case. Kindly b in touch

Alimony depends on the living standard of the person before and after the marriage and after the separation. In your case also chances will be less but this condition also applies. after receiving the court notice of section 13 1(ia) you need to give reply of this notice with the help of an advocate.

First of all you need to reply to that notice and deny the allegations levied on you. And you can always file a petition under section 125 CrPC or under DV act and claim your monthly alimony or the lump sum alimony. It will depend upon the monthly earnings of your husband. For more legal assistance I am just a call away.

yes you should respond and you have to file a reply to the divorce petition. as your husband has filed a divorce petition against you and he has taken the ground of cruelty against you. in such a case you have to give your reply and even have to appear before the court on the next date of hearing with your reply to the same.

it's important to understand as to what do you want from this marriage? Clearly, the reason you've mentioned that had made your marriage not workable presents only one solution that is divorce. Interestingly, he is the one filing for it and as it is clear that you are also not happy with the marriage. It would be appropriate that you give him the proposal of mutual divorce without getting in the hassles of litigation. Since, you are working and you haven't showed your intention to get maintenance from your husband in your query, you both can end this marriage peacefully by opting for mutual divorce. Now, in order to know as to how will that work out, you may consult me.
