Mutual consent Divorce special marriage Act muslim marriage

If the husband is an NRI and may not be able to come for court hearings too often etc. Is his presence on Skype or video enough or is it mandatory for him to be present physically as I do not want to face him. Also the reason for mutual divorce is not consummation of marriage, is it necessary that both have to live away from each other for at least 1 year even in this reason? Its been more than 1 year of Marriage however e have lived apart only for 4-5 months now and want to separate ASAP.qWhat is the fastest way of getting divorce decree? Marriage happened in Delhi.

For mutual divorce there are two motion for first motion ur husband can execute special power of attorney in his father, brother or close relative name and SPA form indian ambassay where ur husband live and that person will gave statement in his behalf in the court and for second motion his physical presence is mandatory. If it yours is a mutual consent divorce then you don’t have to wait for so long.

It takes about 30-45 days from the first appearance of both the parties until the next and final date in about 30 days time.

Use of Skype is possible as Bombay High Court allowed recently. But it defends if the Court agrees for one.

divorce can be obtained through mutual consent under special marriage laws as well. the husband will have to be present as the decree for divorce by mutual consent will have to be signed by both of you and his presence cant be done away with completely

Dear Marriage,
You want to go for divorce against your NRI husband.
Normally in any case before court issue summons to opposite party and same will be done in your case too, at least once to hear him.
You have passed one year it is one point of law that now you can go for divorce filling.
You have been conjugated only for few months and now you are willing to go for divorce.
