mutual consent divorce initiated but delayed due to pregnancy

13-May-2023 (In Divorce Law)
sir , I am female and applied for mutual consent divorce and granted 6 month cooling period by court ..Meanwhile I am pregnant but will go ahead with divorce as we cannot stay together ,,i want to give birth of child but do not want to give fathers name in records as I am pursuing divorce proceedings which will take few months. 1.Is it possible to deliver baby without mentioning fathers name in birth certificate or hospital records?Pls suggest solution to it . 2.Do I need to inform divorce court about my pregnancy .6 Months cooling period has passed but we have not made 2nd appearance in court as my husband is out of India and I am pregnant so want to delay appearance and settlement till child birth. if it is something that you got to know post signing the settlement agreement, then this will be considered to be a new development and proceedings could be put on hold. rest, it depends on the facts and circumstances

you will have to mention this fact to court. however biological father name have to be mentioned in the records. otherwise it will be a illegitimate child..rest we do a con call and discuss the this issue.

Hi,
I would suggest you to ask your husband to give someone power of attorney to and thereafter get the signatures done for 2nd motion, further get divorce before your delivery.
