Maintenance as applicable after divorce

I have a daughter aged 5 years and I am a working Software professional. Please let me know if myself along with my daughter are entitled for maintenance ?My monthly income is around 40k

you are not entitled for maintenance as you are earning well enough but surely for the daughter the father should have to pay maintenance under section 125 of CrPC. If Divorce Case is still pending then resolve all this issue with the help of your Advocate through mediation.

yes if your husband is earning more than you and if you have not already gone to a one time settlement on to a mediation center with a clause that you agreed or have in your divorce decree have settled down with the clause that you are not in the need of the money then also you can claim for your daughter.rest can get you by seeing ur papers.

on the above mentioned query the legal advice is that if your income is less than your husband's income then you are entitled for the maintenance with your child but if your income is greater than your husband's income then the husband is entitled to the maintenance from you .
