Is divorce required if marriage is not legally registered?

10-Jul-2024 (In Divorce Law)
My husband and I are Hindu and seeking a divorce but our marriage isn’t registered. We don’t have a marriage certificate so do we still file for a divorce or it can be just nullified on mutual grounds.

Yes. Even it’s not registered, as per the legal requirement you need to divorce legally. If you are married as per Hindu religion then you are married as per customs even though your marriage is not registered you need to apply for divorce through court

Hi, if you are married as per customs prevailed in your community. There is no legal mandatory requirement of registration of marriage. You can file divorce if you have completed one year of marriage then you can go for divorce filled by ether party or mutually. Nothing can nullify the valid marriage.

For Hindus marriage registration is not compulsory. A marriage which is salumanized as per the Hindu customs and rituals is sufficient to treat it as a valid legal marriage. if you are seeking a mutual consent divorce I can get it done with whatever you are having.
