I want to know about maintenance amount for child and me

I get married in 2019 now my son age is 3 years.my husband work in ship. anual salary is 10-11 lakh.iam working in pvt sector monthly 38k & 4.5lakh/year.my husband not taking any responsibility of me nd child.he is suspicious and more aggressive character and use to harm me physically and mentally so iam staying seperate.as he is staying far he don't know things are how difficult to take care of child in husband absence.i don't want to give divorce. want to stay with husband but he ask devorce

Better file Restitution of Conjugal Rights under Section 9 of Hindu Marriage Act and also file maintenance for yourself and your son. Since he is unnecessarily having suspicion about your character the Court will definitely grant interim maintenance of yourself and your son. In the meanwhile sent representations to his employer to deduct from his salary and credit to your account towards maintenance of your child.

yes you can file a petition under domestic violence act in which you can claim maintenance for yourself and your child as the income which you are earning is not much, further as per the law the wife is Entitled to the same standards of living as husband is enjoying, in this case you can apply for maintenance and protection order and other reliefs under domestic violence act, under domestic violence act there are all the provisions made which are required for a women, you get all the reliefs hence apply under this act, his salary also can be attached if he does not pay maintenance.
