you will have to apply for grant of mutual divorce before the family court of your respective district. you will require a lawyer to draft everything and file it in the court. the fees details can be discussed later but you can tell me the reasons and everything. but there has to be some separation

Dear Client,

If you and your husband do not want further relationship any more. also both of you wanting the divorce then it is good . tell your husband to file the case from his side, for mutual divorce. only you will have to appear before the court, and accept for the same after getting summon/ notice.
for this you will not have to hire a lawyer. Also ask your husband to arrange for the same. pls. consult and rate it

Hi,

In this situation, you may proceed to file 'Divorce by Mutual Consent' under Section 13 of the Hindu Marriage Act. However, do you mean that you have only stayed together for two months? In that situation you would have to take more time as the Court does not permit divorce unless one year has elapsed since the date of the marriage.

However, in the meanwhile you can have the papers for mutual divorce drawn up and the parties can come to a settlement.

Hi,
To file a mutual divorce, you need to file settlement deed. Thereafter on the basis of the settlement deed you have to file petition for divorce (first motion), thereafter you would need to file second motion.
For more information, feel free to have a word with me. All the best.
