My marriage took place on November 22, 2024, and on January 1, 2025, I caught my husband (28 years old) cheating on me with a 43-year-old woman. He was seen going to her apartment with a condom. However, the woman claims that she was unaware of the situation regarding the condom, and my husband denies having any knowledge of my intentions. Well, you can merely seek Divorce on the ground of Adultery, as Supreme Court of India itself has declared that Adultery is no more a legal offence. Hence, morally Adultery is an Offence, but legally it is not.

I understand the emotional distress this situation has caused you. Since you have already filed a complaint with the Mahila Ayog Kendra, you should ensure that all relevant evidence—such as messages, call logs, or witness statements—is documented to support your case. Additionally, based on the facts provided, you may consider filing a case under Section 498A IPC (cruelty by husband), Section 406 IPC (criminal breach of trust), and Section 497 IPC (adultery, if applicable as per current legal provisions). A petition for divorce under cruelty and infidelity grounds can also be filed if you choose to separate. For financial security, you may claim maintenance under Section 125 CrPC or the Domestic Violence Act, 2005, seeking protection, residence, and monetary relief. Given the legal complexities, I strongly recommend engaging an experienced family law advocate to represent your interests effectively. Please let me know if you need further legal assistance.
