How to get divorce under section 13b?

we got married on 27/04/2015 and after one month we felt that we as a couple can not leave together and we separated and decided to take the divorce and have registered the divorce deed at the sub registered office with proper stamp duty. now according to section 13 B : mutual consent, A joint petition has to be filed in this regard and after the filing of the same the Court grants a minimum period of six months (and maximum 18 months) for the parties to come again and make a statement confirming the said consent. Divorce under Section 13 (b) of the Hindu Marriage Act, is a divorce sought by both husband and wife with mutual consent. The procedure mentioned by you is correct. However, the key is to draft the said petition in a careful and thorough manner so that all the aspects of the settlement are covered, including the division of assets, if any.

Yes there is a waiting period involved but once that period is over then the court grants divorce.

For getting divorce decree under section 13/B separation of 1 year is must and 6 months cooling period cannot be waived by any court except supreme court. Once petition is filed it takes at the most 7 months to obtain decree
