How long to wait for filing mutual consent divorce.

We got married in Feb 2023, he is working abroad and I moved in with him for 3 months after wedding, he sent me back in May 2023 and I lived with my parents till Oct 2023, I moved with him again in Nov and Dec 2023. Our marriage of 1.5 years is not working for the both of us and we've cohabited only 5 months totally and officially seperated for 7 months. How can we file for mutual consent divorce, he's abroad and I'm working in India. Both don't want any financial settlement or spousal support.
Hi, Fir filling Divorce your marriage should complete one year at least. And it you should show at one year of living separately. If marriage is not working out and both of you wanted to go for mutual consent divorce then another condition may be relaxed if first condition is fulfilled. In you case it is ok. You both can go for MCD.
you can both file for mutual consent divorce on ground of irretrievable breakdown of marriage, as your husband is abroad you can file the petition online and get a divorce, if he is ready to come to India it is better, if not he can appear online and also appoint a power of attorney by executing a power of attorney before the Indian embassy there in foreign country. so get the required documents and file mutual consent divorce.
