How can I separate from my wife

dear sir , ibelonging to hindu community. i married a another cast man in 2002 we have no child.our parents are against with this marriage.from the starting he was job less.by force he did the small jobs and create more debits to public.iam an employee in stock market i had cleared his debits more times.in 2015 he make a large amount of debit. with out my permission he sold my jewellery .i am facing many insults by him.he harrasing in daily for money.now iam not able to do the job.iam fedup with my relationship.i want to seperated to him please kindly advise me to what can i do now.

You can file for divorce before the family court as you have good grounds to obtain divorce. In case , he is agreeable for divorce by mutual consent you can as well go for mutual consent divorce and it will be faster. As for his misdeeds of jewellery sale, etc. you can file a criminal complaint and he will be liable u/s. 406, 420 IPC.

First u discuss with ur husband about the problem u are facing because of his behaviour, and clearly tell him that u can't bear the harassment any more.still he continues and if u finally decide to leave him you can file a divorce case.

Hopefully you have the marriage registered and you have a marriage certificate.
it also appears that your spouse is not interested in leading a happy married life and take up responsibilities and instead dependent on you, your income and your properties.
Also the fact he has been abusing you.
You should approach the family mediation center / women police station and ask for counselling.
If counselling works and your spouse changes his habits, well and good.
Or else, you should prepare your self mentally and financially to file for divorce and get done with this marriage which is not working.

Getting separated through affidavit though it is good idea but it is not valid in eye of law. You can file application for judicial separation before concern family court. If it is not contested, it will be granted without taking much time

Only by way of affidavit one can not get divorce. There is a law and stipulated conditions for getting divorce by either party I. e. husband or wife. Therefore contact a good lawyer, apprise him about all facts and act accordingly as per his advice.

You may file a petition before appropriate Principal Judge, Family court for getting decree of judicial separation from your wife under provisions of relevant applicable law and only after grant of decree of judicial separation, you may leave separately .

No, you can't be separated from your wife by an affidavit. In order to get separation from your wife, you have to file a divorce petition in the concerned Family Court on the grounds enumerated in section 13 of the Hindu Marriage Act.
