Q: Can someone claim your property? ,What to do if someone claims our land ?

Sir, My paternal uncle and aunty died in 2004 in road traffic accident.They had no child.. Their LIC along with all the payment was made to my grand mother by civil court purnia( the descion also stated that they didnt have a child)..My grandmother also died in 2008 and then we found out that my uncle had a land in the name of my aunt but since my aunt was a housewife and my uncle earning .My father applied for succession in patna civil court and got the succsesion ..He filed for mutation of land got that also..So he sold the land also to another person..Now when that other person went to construct his house..Some goons came and told him that they bought the land from my uncle's son(which never existed)..They are also having mutation along with resgistry paper..What should we do? How do we proceed further. and what are our chances to get the land back..? what is land grabbing act ?

If all the valid and legal documents are in your favour there is no need to be panic or worried. Contact a good lawyer, apprise him about all facts, documents and act according as per his advice. You will get relief.

Q: How can i stop my father from selling property ?

Sir, my father is a completely alcoholic man. he always use to say to my mother that I will sell that land. actually we have a land outside city which is in my father's name. how to stop land from being sold ?, can we do something that that land can't be sold without our family concern. Please help.. please

As per law of the land a person who is not of sound mind or one who is unable to think or take decision with healthy mind can't execute an agreement to sell his land. Contact a good lawyer and act accordingly as per his advice.

Q: Stay order in 498a case filed u/s 498a against husband by in-laws

My self currently living in delhi with my wife n son of 3yrold (All are Hindu by religion), my father in law from Dumraon has filled a complain against me n my family members under section 498a,the matter is under Family welfare department and is about to proceed to local mahila police station n further. We have already taken bail from district court regarding this but now we want to take stay on this matter before it goes to police station or court. Please help me with the detailed procedure that how to proceed with the matter to take 498a stay order.

If your wife is living with you in peaceful coheasive manner/atmosphere , how can his father file a case under section 498A. However, staying or quashing the case you have to file application before high court.

Q: Re opening of an land encroachment case after 20 years of the case, can you reopen a case after 20

Under any encroachment case 15-20 years back, if one got the release on paper by the administration itself saying there is no encroachment . Then what is the chance of reopening the case after so many years and what could be the probable decision by the administration?, can a disposed case be reopened ?

That depends upon nature of the decision. If the decision is based on relevant facts and documents then decision can not be changed. But if the decision is based on wrong facts and documents then the case can be reopened and decision can also be changed.

How to get permanent stay order on my Part Land, Our other family are capture my land & started illegal construction. Please Advice How to gen Permanent Stay Order on this land. Can i get online stay order on property?, who can take stay order on property ?

There is no permanent stay like order under law. If your other family members are making construction on your land , inform the police and if the police failed to take any action , contact a good lawyer , apprise him about all facts and act accordingly as per his advice.
