Household items and electronics division during divorce settlement

17-Feb-2025 (In Divorce Law)
How are the household items like electronics, furniture, other kitchen items divided when husband and wife are going for divorce. Me & my husband have agreed to go for divorce via mediation in supreme court. Gold and silver jewellery discussions going on. There is no discussion regarding the other household items. What happens to those items? Can wife ask to take them or husband has the sole ownership for them as he had paid for them?

Dear client based on your question, If both spouses used the items during the marriage, they are considered joint martial property, regardless of who paid for them . It should be divided mutually or equally based on the necessity of the usage . For just cases we can help you with proper legal guidance.

As far as household items are concerned, it is a mutual decision between the husband and the wife to divide things. If your husband is agreeable that you take away certain household items despite he having made the payment, then the issue ends there. However, if he intends to retain them as he has paid for the same then there is no question of you claiming. Feel free to contact me for seeking any legal advice as regards the same.

Well, if the Husband has paid for the items, the n of course, Husband will be considered as the owner of such items. Even if Wife claims to take such items, then, she has to put concrete reasons for it, as she is not the owner of such items!
