Hindu Woman Seeks DV, Divorce, Streedhan Advice

30-Apr-2025 (In Divorce Law)
As a Hindu woman, I filed DV and dowry cases in Mumbai (2023) and a divorce case in Hubli (2024), with a Supreme Court transfer petition. I have streedhan (gold) proof but no interim started yet and no relief due to opponent’s lawyer delaying hearings. I’m unemployed, stressed, and family pressures me to settle. How can I recover streedhan, get maintenance, and speed up my cases under Hindu Marriage Act? Should I fight or settle? Need affordable legal advice.

You have strong legal remedies. File an interim application in the DV case for maintenance and streedhan return under Sec 12 of the Protection of Women from Domestic Violence Act. Since you have proof of streedhan, you can seek court direction for immediate return. For delay tactics, move an application for expedited hearing and bring it to the court's notice. The Supreme Court transfer petition should also highlight mental and financial distress. Settlement is personal, but legally, you’re entitled to maintenance, shelter, and streedhan recovery. Don’t settle under pressure—explore all rights first.

Given your situation, it is important to pursue both your streedhan recovery and maintenance claims actively while also ensuring the transfer petition is followed up to avoid further delays. Delay tactics by the opposite counsel are common, but legal remedies exist to expedite hearings and seek interim relief. You also have the right to claim maintenance under Section 24 of the Hindu Marriage Act and potentially under DV proceedings. Whether to fight or settle depends on the strength of your proofs, financial needs, and long-term goals. I recommend a detailed consultation to assess your documents and strategize the most cost-effective and result-oriented course of action. Please feel free to connect for further guidance.

If your consideration is Money from your husband, then it would be beneficial for your to fight the case till when atleast you have received a favourable interim maintenance order in your favour. However, if your husband is willing to settle the cases by returning back the streedhan and by paying you alimony (if your require), then you may also settle the case as your requirements are being fulfilled. In case you require any further legal assistance you may contact me.

You have legal rights under the Hindu Marriage Act and Protection of Women from Domestic Violence Act. File an interim maintenance and streedhan recovery application. You may also file a transfer petition to combine or speed up proceedings. Settlement is a personal decision, but don’t settle under pressure. A good legal aid NGO or women’s helpline may help with affordable assistance.
