Hi my husband filled for divorce I am ready to give him a divorce but my lawyer telling can We ask maintenance but I don't need to he's money and I no need to any touching with him so without my permission my lawyer can file for lnterlacturay petition is it possible or not..?I don't need maintenance and nothing no need from he's side I need only divorce..I have 4yrs girl child..

Dear Madam,
if your Advocate acting against your instructions then change him immediately. Normally he cannot claim interim maintenance without your signature. Tell him in writing accordingly. Also tell your husband that you are ready give divorce.

okay I understand your questions so your husband filed divorce you are also ready to give divorce nit your advocate told you to take a maintainance from him right so with out your signature he is not file any maintenance application with out your signature so do you need any legal help contact me thank you

Whether you want maintenance or not is your choice. You have a right, if established as to why you need it. Your advocate can’t force you to seek it.

If you are filing a mutual consent petition, the conditions of dissolution would capture whether or not you are seeking maintenance. If it’s a contested petition, it’s also your prerogative to claim or not to claim maintenance for you and your child. If you don’t want to, you don’t have to.

your lawyer cannot file application for maintenance without you signing, but i think your lawyer is right as you have a kid also it is better to get something, still if you say you do not want anything you can tell your lawyer, not to apply for maintenance and just try to get the divorce, if you do not want me as maintenance and if you can take care and responsibilities of child without husband's financial support then clearly speak to your lawyer.

it is like this: When your lawyer (if) files the IA or interlocutary application invariably it should be accompanied by a verifying affidavit signed by you and attested by a notary. if you have not signed any such affidavit then he has not filed any IA for maintenance.
