Q: File consent for divorce now wife demanding more money
Hi AllI and my wife filed for mutual divorce after a year of seperation based on her choice and first hearing completed. Now wife is demanding to pay money she spend on marriage to come and attend final hearing , what can be done in this scenario. I will not be able to efford the money she demands nor believe they spent such extravagant amount on simple marriage
Advocate Priyanka Y answered
Since it’s a mutual consent, you can either accept the demand on reject. On rejection, the mutual consent petition will not survive. It’ll be dismissed. If it’s unacceptable for you, try to convince her during the mediation process and if she still isn’t, then you’ll have no choice but to withdraw from the petition. You or her would end up filing a contested petition.
Q: Uncontested divorce online application
HiIf I file for mutual divorce through an online application, to which court will the divorce case go?nTo which court my wife and I should go to do the final signature to divorce?nnRegards,nVikas
Advocate Priyanka Y answered
There’s no online system to file a divorce petition. Mutual divorce petition can be filed with the jurisdictional court where either one of you have a permanent address or an address proof which is not permanent, but has to reflect on any Iliad card.
Q: Hi my husband filled for divorce I am ready to give him a divorce but my lawyer telling can We ask m
Hi my husband filled for divorce I am ready to give him a divorce but my lawyer telling can We ask maintenance but I don't need to he's money and I no need to any touching with him so without my permission my lawyer can file for lnterlacturay petition is it possible or not..?I don't need maintenance and nothing no need from he's side I need only divorce..I have 4yrs girl child..
Advocate Priyanka Y answered
Whether you want maintenance or not is your choice. You have a right, if established as to why you need it. Your advocate can’t force you to seek it. If you are filing a mutual consent petition, the conditions of dissolution would capture whether or not you are seeking maintenance. If it’s a contested petition, it’s also your prerogative to claim or not to claim maintenance for you and your child. If you don’t want to, you don’t have to.
