Whether domestic violence case can be filed from parental place situated in a state different from the matrimonial place situated in other state

hello

yes you can file a domestic violence case from whatever place you are residing .
and if you have already filed any case in any other jurisdiction where you do not live presently then you are having a right to transfer that case presently wherever you live .

In order to file domestic violence case you can move to district court and for transfer of cases you can approach High court

aap agar koi bhi case apne husband k against file krte h to aapke pass legally sono options h aap dv ka case apne parental house or matrimonial house se bhi kr sakti h ye poori tarha legal h or agar aapke husband aapke virudh apne yah se case krte h to aap usko highcourt se apne yah transfer kra sakti h

Yes you can lodge your case where you are residing right now... As you are aggrieved person so you will be allowed to file anywhere....You can have a reading under Section 27 of the Domestic Violence Act...
And in case there exists a problem in future then you can file a transfer application for the case to be transferred at your place...

yes the women have 3 rights to file a complaint against her husband
1 that palace weather she or he got married
2.where wife or husband living
3.where wife parental house
4.where the wife and husband went first time after married

According to sec 27 of Dv Act you may file the case from parental place.
The court of Judicial Magistrate of the first class or the Metropolitan Magistrate, as the case may be, within the local limits of which-

(a) the person aggrieved permanently or temporarily resides or carries on business or is employed; or

(b) the respondent resides or carries on business or is employed; or

(c) the cause of action has arisen,

shall be the competent court to grant a protection order and other orders under this Act and to try offences under this Act.

(2) Any order made this Act shall be enforceable throughout India.
