False DV Case & Huge Alimony Demand After 4 Years of Separation
04-May-2025 (In Divorce Law)
Married 9 yrs ago, separated for 4. Son is with wife who denies me access. I left due to cruelty. She earns ₹70K in PSU bank, didn’t support household. During my business failure, she was active on dating apps. I’ve call recordings of her plotting against me. Mutual divorce denied unless I gave up son. Now she filed DV case demanding ₹1.4Cr + ₹50K/month. I earn ₹4-5L but have a medical condition. What legal strategy should I follow? Can I avoid maintenance? Please advise.
You cannot escape payment of maintenance. However, you can always state that your wife is capable of looking after herself. Further as far as maintenance to son is concerned, it is something both you and your wife are liable to bear. Feel free to contact me for seeking any legal advice as regards the same.
If you want your son's custody, you will have to file a seperate case of child custody in Court. You may request for access to meet the child as well every week.
If the wife has committed some illegal actions, you may also take actions against her by filing appropriate civil/criminal cases against her.
More often that not, the law in matrimonial disputes are favouring women, so you must take action cautiously.
in case you require any further legal assistance you may contact me.
